Understanding New York Marijuana Laws

Before visiting a dispensary in New York, make sure you meet the following requirements:

  • You must be 21 years old.
  • You must have a valid, government-issued photo ID.

If you are looking to purchase medical cannabis in New York, you will need a valid medical marijuana card.


What Are the Cannabis Purchase & Possession Limits in New York?

Both residents and out-of-state visitors are allowed to purchase and possess cannabis products from state-licensed dispensaries in New York. However, there are limits that recreational shoppers must abide by.

According to state laws, recreational cannabis consumers can purchase and possess:

  • Up to 3 ounces of cannabis flower; AND
  • Up to 24 grams of concentrated cannabis products, including cannabis vapes, edibles, topicals, concentrates, etc. 

These totals are cumulative, allowing shoppers to hit their purchase limit through a combination of products like flower, pre-rolls, concentrates, vapes, and more.

Where Can I Use Cannabis in New York?

Smoking or vaping cannabis in New York falls under the smoke-free air laws, which means it’s allowed anywhere tobacco smoke is permitted. However, there are a few caveats for cannabis use.

Marijuana consumption is not permitted in the following scenarios: 

  • Federal land or property
  • Any motor vehicle
  • Around a minor
  • Traveling across state lines

Businesses, landlords, and certain municipalities may have additional rules regarding use and possession of recreational cannabis. You should always check the rules for your location before consuming marijuana.

New York dispensaries accept cash and many accept debit cards as well. Unfortunately, due to federal regulations, credit card payments are not possible.
