Is cannabis legal in Illinois?

llinois legalized the sale of medical cannabis in 2013, under the Compassionate Use of Medical Cannabis Pilot Program Act, now called the Compassionate Use of Medical Cannabis Program Act. Adult-use cannabis sales were legalized in Illinois on January 1, 2020 for anyone 21+ years of age. This means you can purchase cannabis products like flower, edibles, concentrates, beverages, and more from state-licensed dispensaries

What do I need to bring with me when visiting dispensaries in Illinois?

All dispensaries in Illinois require you to bring a state-issued ID in order to purchase marijuana products. For medical use, you also need to bring your Illinois-issued medical marijuana card, in addition to your state-issued ID.

Where can I consume marijuana products in Illinois?

You can use marijuana products in private (non-public) spaces. For example, you may consume cannabis in your home but not in a public park.

What is the state tax on marijuana in Illinois?

Medical cannabis patients in Illinois will pay a flat tax of 1% on every purchase. Adult-use cannabis products have a sales tax based on the amount of THC and the type of product:

• 10% sales tax - cannabis flower and products with less than 35% THC

• 20% sales tax - cannabis-infused products like edibles

• 25% sales tax - products with more than 35% THC 

These amounts are in addition to local state, county, and municipal taxes applied at the dispensary.

How much cannabis can I purchase in Illinois?

There are different purchase limits for Illinois residents, non-residents, and medical cannabis card holders.

Medical Card Holders
Registered qualifying patients and their designated caregivers can purchase or possess up to 2.5 ounces of medical marijuana during any 14-calendar-day period. Please note, medical cannabis in Illinois is only available to patients who have an Illinois medical card.

Adult-Use, Illinois Residents
Anyone over the age of 21 that resides in Illinois can purchase:

• 30 grams of marijuana flower

• 5 grams of marijuana product in concentrated form

• 500 milligrams of THC contained in marijuana-infused products

Adult-Use, Non-Residents
Anyone over the age of 21 who does not reside in Illinois can purchase or possess:

• 15 grams of marijuana flower

• 2.5 grams of concentrates

250 milligrams of THC contained in a marijuana-infused products.

These totals are cumulative, meaning a person 21 years of age or older may possess a combination of marijuana flower, cannabis-infused products, and concentrates up to the limit for each category of product.
